JANESVILLE — Criminal charges will not be filed against a 59-year-old sex offender who provided misleading information to the Wisconsin Department of Corrections about where he will be living in Janesville.
According to the Janesville Police Department, Kevin Spaulding has declared himself homeless. He must still check in with the statewide sex offender registration program every 7 days about where he’s been staying. He has recently been staying in downtown Janesville, Janesville police believe.
It is not against Wisconsin law for a registered sex offender to declare themself homeless, Janesville Police Chief Chad Pearson said.
Spaulding recently claimed he’s been living at 1816 Green Valley Dr., in Janesville. Janesville police released that information publicly on Thursday. On Friday, in a subsequent release. Janesville police said Spaulding had provided misleading information regarding his address, and that he was not staying at 1816 Green Valley Dr.
Pearson said the landlord at that address reached out immediately to Janesville Police and the Wisconsin Department of Corrections, saying Spaulding does not live there and that his presence would violate the lease.
Pearson said Spaulding is believed to be associated with someone at that address who lets him stay there once in a while. Since the residency was misleading but not technically a lie, there will be no charges.
Pearson said Janesville police have verified with the Wisconsin Department of Corrections that Spaulding is not residing at the Green Valley Drive address.
Spaulding was convicted of two counts of first-degree sexual assault of a child in 1993 and 2007 and one count of third-degree sexual assault in 1990 in Rock County.
He is a lifetime sex offender registrant which requires him adhere to the requirements of the Wisconsin Sex Offender Registration Program, the Janesville Police Department release said.
The requirements for registrants include, but aren’t limited to: no unsupervised contact with minors; no contact with victims; no drug use; comply with standard sex offender rules; cooperate with electronic monitoring; have regular face-to-face contact with law enforcement.
